Terms of Service

By accessing or using MOGBOARD ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms apply to all visitors, registered users, and anyone who interacts with the Service. MOGBOARD is operated by Robert Moiseyev, an individual based in Sweden and is subject to Swedish law and EU regulations, including the General Data Protection Regulation (GDPR).

You must be 18 years of age or older to use MOGBOARD. By using the Service, you represent and warrant that you are at least 18 years old.

If we discover or reasonably suspect that a user is under 18, we reserve the right to immediately terminate their account and delete all associated data without notice.

When you upload a photo to MOGBOARD, you represent and warrant that:

• The photo is of yourself. You must not upload photos of other people without their explicit written consent.
• You own the photo or have all necessary rights to upload and display it.
• The photo does not infringe on any third party's intellectual property, privacy, or publicity rights.
• The person in the photo is 18 years of age or older.
• The photo does not contain nudity, sexually explicit content, or illegal material.

By submitting a photo, you grant MOGBOARD a worldwide, royalty-free licence to display, store, and process the photo in connection with operating the Service, including displaying it on the public leaderboard and your profile page. This licence ends when you delete your account. Note that cached copies of publicly served content may persist in third-party caches (such as CDN edge nodes or search engine indexes) for a period after deletion.

You agree not to:

• Upload photos of other people without their explicit consent.
• Use the Service to harass, defame, or harm any individual.
• Attempt to manipulate scores, ranks, or the leaderboard through automated means or abuse of the scanning system.
• Use the Service for any commercial purpose without our prior written consent.
• Reverse-engineer, scrape, or otherwise attempt to extract data from the Service in bulk.
• Impersonate another person or entity.
• Use the Service in any way that violates applicable laws or regulations.

Scores generated by MOGBOARD are produced by an AI model and are for entertainment purposes only.

These scores are not professional assessments of your attractiveness, health, worth, or any other personal attribute. They are not medical, psychological, or scientific evaluations. AI scoring is inherently imprecise, subjective, and subject to variation between scans. AI models may also reflect biases present in their training data.

Your score is generated by fully automated processing with no human review. You have the right to contact us to contest your score or request a human review. MOGBOARD makes no representations about the accuracy, fairness, or meaning of any score. Do not make decisions based on your MOGBOARD score.

Your display name, score, face photo, and trait analysis are publicly visible to all visitors of MOGBOARD, including those who are not signed in. By submitting a scan, you acknowledge and consent to this public display.

You can remove yourself from the leaderboard permanently by deleting your account via the user menu.

We reserve the right to remove any content, suspend, or permanently terminate any account at our sole discretion, at any time, for any reason, including but not limited to violation of these Terms, receipt of a valid complaint, or any conduct we deem harmful to other users or the Service.

You may delete your own account at any time from the user menu. Account deletion permanently removes all of your data from the Service.

If you believe a photo has been uploaded without the subject's consent, or if any content violates these Terms, please report it using the in-app report button on any profile page, or contact us directly at: bluepeak.enterpriseco@gmail.com.

Please include a description of the content and the URL of the profile in question. We will investigate and take appropriate action, typically within 5 business days, which may include removing the content and terminating the account.

MOGBOARD respects intellectual property rights. If you believe that content on the Service infringes your copyright, you may submit a takedown notice to us at: bluepeak.enterpriseco@gmail.com.

Your notice must include:

• A description of the copyrighted work you claim has been infringed.
• The URL of the content you claim is infringing.
• Your contact information (name, address, email).
• A statement that you have a good-faith belief the use is not authorised by the copyright owner.
• A statement, under penalty of perjury, that the information is accurate and you are the copyright owner or authorised to act on their behalf.
• Your electronic or physical signature.

We will process valid notices promptly. Repeated infringers will have their accounts terminated.

Counter-notice: If you believe your content was removed in error, you may submit a counter-notice to us at the same email address. Your counter-notice must include: (a) identification of the removed content and its location before removal; (b) a statement under penalty of perjury that you have a good-faith belief the content was removed by mistake or misidentification; (c) your name, address, and email; and (d) your electronic or physical signature. We will forward valid counter-notices to the original complainant. If we do not receive notice that legal proceedings have been initiated within 10 business days, we may restore the content.

The MOGBOARD name, logo, design, and original content (excluding user-uploaded photos) are owned by us and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our prior written permission.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be error-free, uninterrupted, or that AI scores will be accurate or consistent.

To the fullest extent permitted by applicable law, MOGBOARD and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to emotional distress resulting from a score, unauthorised use of your photo by other users, or any downtime or data loss.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law, including consumer protection rights you may have under Swedish or EU law.

These Terms are governed by the laws of Sweden and, where applicable, the laws of the European Union. Any disputes arising from these Terms or your use of the Service shall be submitted to the exclusive jurisdiction of the Swedish courts, with the District Court of Stockholm (Stockholms tingsrätt) as the court of first instance, unless mandatory consumer protection laws in your country of residence require otherwise.

If you are a consumer in the EU, you also have the right to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. For material changes, we will make reasonable efforts to notify registered users by email. Continued use of the Service after changes constitutes your acceptance of the updated Terms.
